The Supreme Court of Lithuania will solve a case involving unprecedented legal questions with respect to the due process of arbitration

The Supreme Court of Lithuania has accepted the cassation appeal prepared by FORT Vilnius regarding legal questions whether arbitration process could be considered as due process, where the founders and management of the arbitration institution represent one of the parties to the arbitration case. According to the cassator, any external objective observer would reasonably have apprehensions with respect to the due process, which is organised by one of the parties to a dispute or their legal advisors.

FORT Vilnius has defended the client and achieved that the decision of the Migration Department prohibiting the client to arrive to the Republic of Lithuania and other Schengen states would be repealed

FORT Vilnius has successfully finished second part of a dispute with the Migration Department regarding the decision to prohibit the client to arrive to Lithuania or other Schengen states. During the first part of a dispute the decision of the Migration Department to refuse extension of the residence permit to the client has been repealed.

FORT Vilnius represents some of the biggest Lithuanian publishers in the court case regarding violation of the copyrights which does not have any analogue in practice of the national courts

Some of the biggest Lithuanian publishers UAB “Alma littera”, UAB “Baltų lankų” leidyba, UAB “JOTEMA”, UAB “Tyto alba” and UAB Leidykla “Vaga”, represented by FORT Vilnius, has filed a claim regarding violations of copyrights which were conducted by internet portal “http:/visosknygos.com”. This is a first case in the country, when court has received a claim regarding “piracy” of books. The above mentioned internet portal has illegally distributed more than 400 books published by the said publishers without their as well as authors’ consents to use or reproduce their works. According to the gathered data the damage done to the copyrights holders amounts to EUR 225,000.

The Court of Justice of the European Union has rejected a request of the Supreme Court of Lithuania to use urgent preliminary ruling procedure in a preliminary ruling case initiated by 262 individuals who had subscribed and paid up the emission of shares of currently bankrupt Snoras bank

On 7 April 2014 a group of claimants consisting of people that had subscribed and paid up the emission of shares of the bankrupt bank Snoras (Snoras), but had not been granted the subscribed shares due to bankruptcy of Snoras, have initiated court proceedings requesting to recognise them as the depositors of Snoras. The group of people seeks to recover in total approx. EUR 2 millions and to receive personal insurance premiums of up to EUR 100,000 each granted by the EU directive on the deposit-guarantee schemes 94/19/EC (as amended by 2009/14/EB). The courts of lower instances have rejected the claim, therefore, currently the case is pending before the Supreme Court of Lithuania.
