Courts of the Member State within the territory of which insolvency proceedings have been opened have also jurisdiction to decide an action of recovery that is brought against a person whose place of residence is not within the territory of a Member State
Situation where an action to set a transaction aside by virtue of insolvency (an action of recovery) needs to be brought against a person whose place of residence is in a different country raises a question of international jurisdiction – i.e which courts have jurisdiction to decide the abovementioned matter.

The amount of the state fee is no longer dependent on how one submits its application
Estonian Supreme Court ruled in its decision dated 10.12.2013, that regulation of the Estonian State Fees Act pursuant to which, the amount of the state fee payable upon submitting an application to the court in civil matters was higher in cases where the application was submitted by any other means than via web page www.e-toimik.ee, was contrary to Estonia’s Constitution.
